Business Calls for Adoption of Key Draft Laws to Improve ARMA’s Effectiveness

The members of the Ukrainian Business Council (UBC), which includes 119 business associations from various sectors of the economy, present to you their compliments and would like to make the following communication:

On September 27, 2024, the National Agency of Ukraine for finding, tracing and management of assets derived from corruption and other crimes (ARMA) during the Conference “Restoring Ukraine – Key Priorities of Business and Government” demonstrated its readiness for constructive dialogue and fruitful cooperation with the business community, noting possible changes to legislation that will increase revenues to the state budget.

The business representatives analyzed a number of legislative initiatives in detail and identified four that will help to fill the state budget in this difficult time for the country.

We call on the Parliament to intensify its efforts and adopt key draft laws aimed at improving the efficiency of the ARMA’s functioning, including those aimed at recovering proceeds of corruption and other crimes:

  1. Draft Law No. 11009 of 12.02.2024 on improving the efficiency of asset management. It is aimed at:
  • Creating preconditions for solving social and domestic issues of IDPs, military personnel and their families;
  • Implementation of the best international practices with a social component in the management of seized assets;
  • Increase transparency of the property management process by ARMA, law enforcement agencies, and managers.
  1. Draft Law No. 11280-1 of 06.06.2024 on the peculiarities of managing cultural property and other assets. It provides for:
  • transfer of seized cultural property to museums;
  • unlocking the management of corporate rights;
  • tracing and identifying unjustified assets.
  1. Draft Law No. 10069 dated 18.09.2023 on improving the efficiency of activities in the field of asset tracing and management. It provides for:
  • ARMA obtaining the right to sell sanctioned assets;
  • unlocking the management of corporate rights.
  1. Draft Law 11137-1 dated 16.04.2024 on the procedure for renewal of subsoil use rights and some other issues in the field of subsoil use. It provides for:
  • creating the possibility of managing assets without special permission during wartime.

Ukrainian business calls on the Verkhovna Rada and MPs to include these priority draft laws in the immediate agenda for their prompt adoption to facilitate the flow of additional billions of hryvnias to the state budget needed for defense.
