The business community welcomes the appointment of the Head of the Economic Security Bureau of Ukraine

Today, August 6, 2025, the Cabinet of Ministers of Ukraine finally appointed Oleksandr Tsivinskyi, who was selected as the winner of an open competition, to the position of Director of the BEB.

The Ukrainian Business Council, which includes 124 business associations from various sectors of the economy, actively supported the draft law on the reboot of the BEB by a commission with the decisive vote of international experts. The business community welcomes the appointment of the new head.

“The appointment of the head of the BEB is extremely important for business. The formation of a modern analytical and law enforcement body capable of effectively countering economic crime, while reducing pressure on honest businesses and protecting the economic interests of the state, is key to the recovery and development of the economy,” said Yulia Chumak, head of advocacy at the Ukrainian Business Council.

After appointing the director, it is necessary to implement other provisions of the Law: to conduct a complete reboot of the BEH, in particular, to re-certify all personnel.

It is also extremely important to establish quality KPIs for the BEH, including the following:

– The ratio of the number of pre-trial investigations initiated to the number of indictments sent to court

– The ratio of the number of indictments sent to the court of first and second instance to the number of convictions in cases investigated by the BEB

– Statistics on suspended criminal proceedings (in dynamics – period to period)

– The proportion of damages recovered in criminal proceedings, the average amount per proceeding.

– The average duration of pre-trial investigations in criminal proceedings, separately the proportion of pre-trial investigations lasting more than 18 months (Article 219 of the Criminal Procedure Code of Ukraine)

– Dynamics of the application of special confiscation and measures against legal entities for criminal offenses investigated by the BEB

– Cases initiated under Article 212 of the Criminal Code: ratio of cases in which there are convictions or cases terminated under Part 4 of Article 212 of the Criminal Code (payment of taxes).

– Dynamics of the number and value of seized property. Comparison with the number of property seizures in similar neighboring countries. Comparison of property seizures imposed and canceled, in quarterly dynamics

– Dynamics of the number of searches (in general, invasive investigative actions) by the BEB. Ratio to the number of searches in developed neighboring countries, as well as the effectiveness of such actions.

– Ratio of the number of cases entered in the Unified Register of Pre-trial Investigations and investigations initiated to the number of convictions that have entered into legal force, as well as the ratio of the number of suspicions issued by the BEB to the number of convictions that have entered into legal force

– Number of business complaints (to the business ombudsman) quarter by quarter.

 

Ukrainian business is ready for constructive cooperation with the new leadership of the BEB, capable of realizing the potential of the agency as an institution that effectively protects the state’s economy and prevents abuse in relations between business and state law enforcement agencies.
